SCHEDULE OF ASSESSMENTS FOR VIOLATIONS OF RULES AND REGULATIONS

Pursuant to the Association’s governing documents the Association may assess reasonable charges for violations of its rules and regulations in order to promote compliance, protect property values, and ensure uniform and equitable enforcement for all owners. These assessments are not intended to be punitive, but to encourage correction of violations, deter repeated noncompliance, and recover reasonable administrative and enforcement costs incurred by the Association. Consistent enforcement supports the safety, appearance, and overall welfare of the community.

After written notice of violation and expiration of any applicable cure period, and following prior warning(s) for the same or similar violation(s), assessments shall be imposed as follows:
1. First violation: $25.00
2. Second violation: $50.00
3. Third and each subsequent violation: $100.00

NOTE: Any assessment not paid within thirty (30) calendar days of the assessment date may be subject to further collection action, including the filing of a lien against the unit, as authorized by the Association’s governing documents and applicable law.

PROCEDURES FOR APPEAL AND HEARING
1. An owner may request a hearing before the Board of Directors to appeal an assessment by submitting a written request (letter, email, or other written communication) to the Property Manager within ten (10) calendar days of the date of the violation notice or assessment notice, whichever is applicable.
2. Requests for appeal or hearing received after the ten (10) calendar-day period will not be considered.
3. Upon timely receipt of a request, the owner will be notified of the date, time, and manner of the hearing, which may be held in person or by teleconference, and which shall occur within fourteen (14) calendar days of receipt of the request, unless otherwise agreed by the parties.
4. Following the hearing, the Board of Directors shall issue its decision in writing within three (3) calendar days.
5. The decision of the Board shall be final.
